1. Scope of Work, Installation and Maintenance

We offer a variety of construction, renovation, improvement, and maintenance services, which may include but are not limited to working with timber, soil, paint, cement, stone, solar equipment, plumbing, electrical systems, tiling, and other materials appropriate to your project. All materials and installations are subject to wear and tear and to external factors such as weather conditions, ground movement, subsidence, moisture, erosion, and sunlight. Regular maintenance by the owner is essential to ensure the longevity of any installation or work. We cannot be held responsible for deterioration, damage, cracking, or other impacts arising from weather, building movement, ground conditions, or any other cause outside our control. Maintenance services may be provided by us at an additional cost, if requested in writing. If any third-party companies or contractors are engaged, any liability for their work remains with them and any concerns should be taken up directly with them.

2. Limitation of Liability & Third-Party Services

Cape Decking Home Renovations & Solar (PTY) Ltd, its employees, agents, marketing partners, and affiliates shall not be held liable for any damages, losses, defects, delays, or liabilities arising from the use of our products, materials, or services, except where expressly required by law. Our role may include introducing you to independent contractors, suppliers, or professionals. Any engagement you enter into with such third parties is entirely at your own discretion and risk, and constitutes a separate contractual relationship between you and the third party. We have no control over, and accept no responsibility for, the conduct, workmanship, quality, timeliness, guarantees, or any other aspect of work performed or services provided by any independent contractor or professional. Any claims, complaints, or disputes arising from their work must be taken up directly with the appointed contractor or third party. We are not party to, nor responsible for resolving, such matters, and you expressly waive any claims against us regarding their actions or omissions.

3. Reviews & Defamation Policy

We strive to provide high-quality products and services. However, we will not be held accountable for negative experiences, poor workmanship, or substandard service delivered by any third party associated with, but not directly employed by, the Company. Unfounded or defamatory reviews that misrepresent our services, falsely attribute issues caused by third parties to us, or unfairly harm our reputation may result in legal action. If you publish false, misleading, or defamatory statements about the Company, we reserve the right to take appropriate legal action, including seeking damages for reputational harm.

4. Specific Requests & Changes

If you have specific requirements or requests, these must be communicated in writing. Any changes to the signed-off work may alter the scope, timeline, bill of materials, pricing, and other factors. If a refund is requested, any costs already incurred (including materials, labour, or third-party expenses) will be deducted from any refundable amount.

5. Delays and External Factors

Delays may occur due to supply chain issues, load-shedding, transportation disruptions, customer-caused delays, weather, or other factors beyond our control. We cannot be held responsible for such delays. If a project takes longer than anticipated due to these factors, we reserve the right to amend the final invoice to reflect supplier price increases.

6. Professional Advice and Inspections

Clients are responsible for arranging and paying for their own building surveyor to assess site suitability before work starts. If you wish to appoint a quantity surveyor, architect, or structural engineer, this must be requested in writing. If we source and refer such professionals, additional costs will apply. Their services are subject to their own terms, and they alone are responsible for their work. We accept no liability for their actions or outcomes.

7. No Warranty or Guarantees Beyond Stated Terms

All warranties, guarantees, and service commitments are explicitly stated in our policies. No additional warranties—express or implied—are provided for products or services not directly supplied by the Company.

8. Indemnity

By using this website or engaging in transactions with us, you agree to indemnify and hold harmless Cape Decking Home Renovations & Solar (PTY) Ltd, its directors, employees, and affiliates from any claims, losses, or expenses (including legal fees) arising from your use of our website, third-party services, or breach of these terms. You are responsible for the insurance and safeguarding of any materials, equipment, or tools left on-site during the project.

All risk for materials, equipment, and tools left on-site remains with the client. It is the client’s responsibility to ensure that these items are secure and insured.

10. Payment Terms

We do not offer payment terms. All payments are due as set out in the quotation and invoice. Failure to comply may result in delays or suspension of the project.

11. Use of References and Photos

By engaging our services, you agree to allow us to use your references and photos of the project for marketing purposes, unless you inform us otherwise in writing.

12. Communication and Agreement

All communications and agreements, including specific requests, maintenance agreements, and changes to scope, must be in writing to be enforceable.

13. Governing Law & Dispute Resolution

These Terms and Conditions are governed by South African law. Disputes shall first be attempted to be resolved through mediation; failing that, in a court of competent jurisdiction in South Africa.

14. Changes to These Terms

We reserve the right to update or modify these Terms and Conditions at any time. It is your responsibility to review them periodically. Continued use of our services or website constitutes acceptance of any changes.
